Agreement to Terms
By accessing or using Color ("the App"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the App.
Use of the Service
Color provides a platform for photographers and artists to share their work, discover art through color, and sell prints. You must be at least 13 years old to use the App.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
User Content
You retain ownership of content you upload to Color. By uploading content, you grant us a non-exclusive, worldwide license to use, display, and distribute your content within the App.
You represent that:
- You own or have rights to the content you upload
- Your content does not infringe on others' intellectual property rights
- Your content does not violate any laws or these Terms
Marketplace Terms
If you sell prints through Color:
- You must have the legal right to sell reproductions of your artwork
- You are responsible for setting appropriate prices
- Color takes a platform fee on each sale (currently 15%)
- Prints are fulfilled by third-party print labs (WHCC)
- Payouts are processed via Stripe according to their terms
- An Artist subscription (Starter, Pro, Premium, or Ultimate) is required to publish listings
Refund & Remake Policy: If you purchase prints through Color and receive a defective or damaged product, we offer reprints (not refunds) in accordance with our fulfillment partner's policies. Reprints are limited to the same specifications as the original order. Buyer's remorse is not eligible for refunds or reprints. For shipping damage, do not refuse delivery—inspect the contents and contact us immediately.
Prohibited Conduct
You may not:
- Upload content you don't have rights to (copyright infringement)
- Upload nudity, pornography, or sexually explicit content
- Upload violent, graphic, or disturbing imagery
- Upload content promoting hate speech or discrimination
- Harass, bully, or target other users
- Impersonate another person or entity
- Upload spam, scams, or deceptive content
- Attempt to manipulate the platform or other users
- Use the service for any illegal purpose
We use automated systems and user reports to detect prohibited content. Violations may result in content removal, account warnings, suspension, or permanent bans. You may appeal moderation decisions within 30 days.
Intellectual Property
The Color app, including its design, features, and content (excluding user content), is owned by Color and protected by intellectual property laws. You may not copy, modify, or distribute our intellectual property without permission.
Disclaimer
The App is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service. We are not responsible for the quality of prints produced by third-party fulfillment partners.
Limitation of Liability
To the maximum extent permitted by law, Color shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.
Changes to Terms
We may update these Terms from time to time. We will notify you of material changes through the App or by email. Continued use of the App after changes constitutes acceptance of the new Terms.
